Terms of sale

These terms of sale govern the subscription to the Tably service, published by LE POISSON BLEU. They apply exclusively between businesses. This is a translation: in case of discrepancy, the French version prevails.

1. Purpose and scope

Tably is an online service published by LE POISSON BLEU, a French SASU with a share capital of €5,000, registered with the Paris Trade and Companies Register under number 951 041 565, whose registered office is at 60 rue François Ier, 75008 Paris, France. It lets restaurants and other food-service businesses create a digital menu, publish it online and generate QR codes. The service is intended for businesses only: by creating an account, the customer declares they are acting for their business and accepts these terms without reservation; they prevail over any other document.

2. Account

The customer creates an account with a valid e-mail address and a password they keep confidential. One account covers one establishment. The customer guarantees that the information provided is accurate and remains responsible for the use of their account.

3. Free trial

Every new customer gets a 30-day free trial, with no payment method and no commitment. Only one free trial is granted per customer. At the end of the trial, the customer receives an e-mail with a link to subscribe. They may also subscribe at any time during the trial: the remaining free days are kept and the first payment occurs when the trial ends.

4. Price and payment

The subscription is offered as a single plan at €8.99 excluding VAT per month, VAT added at the applicable rate. It is payable monthly in advance, by card or any other method offered by our payment provider Stripe, and renews automatically each month. An invoice is issued at each renewal and made available to the customer. Any price change is notified by e-mail at least 30 days in advance and applies from the following renewal; the customer may cancel before it takes effect.

5. Late payment

If payment is not received when due (end of the free trial or failed payment), the customer is notified by e-mail and has 7 days to pay. After that, their public menu is suspended: it remains visible but is marked "Suspended", and the editing area is locked until payment. If still unpaid 90 days after the due date, the menu and its content are permanently deleted, after a final reminder sent 7 days before. In accordance with article L441-10 of the French Commercial Code, any amount unpaid when due automatically bears late-payment penalties at three times the French legal interest rate, plus a fixed recovery fee of €40.

6. Term and termination

The subscription has no minimum term. The customer can cancel at any time from their dashboard ("Manage subscription"): cancellation takes effect at the end of the current, already paid monthly period, with no pro-rata refund. The customer can also delete their account at any time from their settings; deletion cancels the subscription immediately, with no refund for the current period. LE POISSON BLEU may suspend or terminate an account for serious breach of these terms, after a formal notice left unremedied for 8 days, or immediately in case of unlawful use of the service.

7. Menu content and AI features

The customer is solely responsible for the content published on their menu (dishes, prices, descriptions, allergens, photos) and for its compliance with regulations, in particular allergen information (Regulation (EU) No 1169/2011) and price display. The photo import and automatic translation features rely on artificial intelligence and may contain errors: the customer reviews and corrects the result before publishing, especially prices and allergens. These features are subject to reasonable daily usage limits to prevent abuse. The customer guarantees they hold the rights to the content they publish and authorises LE POISSON BLEU to host, translate and display it solely for the purposes of the service.

8. Availability and support

LE POISSON BLEU uses reasonable efforts to keep the service available 24/7 (best-efforts obligation), subject to maintenance, interruptions by its technical providers and force majeure. Support is provided by e-mail.

9. Liability

LE POISSON BLEU is only liable for proven fault. Its liability is limited to direct damage and capped at the amounts paid by the customer over the last 12 months. It is not liable for indirect damage (loss of revenue, customers or reputation), nor for content errors covered by section 7.

10. Personal data

Personal data is processed in accordance with our privacy policy, available from every page of the site.

11. Changes to these terms

LE POISSON BLEU may update these terms. The new terms are notified to the customer by e-mail at least 30 days before they take effect; if the customer does not cancel before that date, they apply.

12. Governing law and disputes

These terms are governed by French law. In case of dispute, the parties first seek an amicable solution. Failing that, the Paris Commercial Court has exclusive jurisdiction, including where there are several defendants or third-party claims.

13. Printed stickers

The customer can order custom QR stickers from their dashboard. The price shown, excluding VAT and including delivery, is that of the selected pack; VAT is added at the applicable rate. Payment is due when ordering. The stickers are made to order by our printing provider and shipped to the address given by the customer; stated lead times are indicative. The customer checks the preview before ordering, and that their menu is published. In case of a printing defect, or a damaged or lost parcel, the customer reports it to us within 14 days of delivery with a photo: we have the order reprinted or refund it. As custom-made products, stickers are not taken back or exchanged outside these cases.
